Enforcement

The procedural rules governing the enforcement of claims in Norway are set out in the Enforcement Act. To initiate enforcement, the claimant must establish a basis for enforcement, such as:

A judgment of a Norwegian court.

An arbitral award handed down pursuant to the Arbitration Act.

An in-court settlement concluded before an ordinary Norwegian court or a settlement in arbitral proceedings conducted pursuant to the Arbitration Act, as reaffirmed by the arbitral tribunal

A judgment of a foreign court or a foreign arbitral award which, under Norwegian law or pursuant to an agreement between Norway and another state, is binding and enforceable in Norway (such as the Lugano Convention 2007 or the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards)

A judgment or ruling by an international court or international body which, pursuant to an agreement between Norway and another state, is enforceable in Norway (such as the EFTA Court or the EFTA Surveillance Authority (ESA))

For a judgment to be enforceable, it must be final and contain an order to pay a sum or perform a cetain action, or to take, refrain from or tolerate certain actions.
