Enforcement
Specific procedural rules on the enforcement of claims in Norway are set out in the Enforcement Act. In order to initiate enforcement, the claimant must demonstrate a basis for enforcement, such as:
- A judgment from a Norwegian court;
- An arbitral award handed down pursuant to the Arbitration Act;
- An in-court settlement concluded before an ordinary Norwegian court or a settlement in arbitral proceedings conducted pursuant to the Arbitration Act, as reaffirmed by the arbitral tribunal;
- A judgment from a foreign court or a foreign arbitral award which, under Norwegian law or pursuant to an agreement between Norway and another state, is binding and enforceable in Norway (such as the Lugano Convention 2007 or the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards)
- A judgment or ruling by an international court or international body which, pursuant to an agreement between Norway and another state, is enforceable in Norway (such as the EFTA Court or the EFTA Surveillance Authority (ESA))
In order for a judgment to be enforceable, it must be final and include an order to pay or render something, or to take, refrain from or tolerate certain actions.
