Tax and duty litigation is characterised by the fact that it often involves large sums of money and is composed of complex factual and financial circumstances. The law is technically demanding and must be presented to judges who are not specialists in the field. Tax and duty cases therefore require a team of dedicated lawyers who can develop and present an argument that makes the court comfortable with delivering a judgement in the taxpayer’s favour.

Tax matters
Thommessen has a long tradition and extensive experience in assisting taxpayers in disputes with the tax authorities. Several of our solicitors regularly litigate tax and duty cases before the courts, including landmark cases before the Supreme Court.
Thommessen has, among other things, litigated cases concerning the exemption method, transfer pricing, transaction costs, tax liability for foreign companies, property tax, etc.
Several of these cases have attracted significant international attention.
Duties matters
Over the past few decades, the tax authorities have placed increased focus on tax law matters, and there has been a significant volume of tax cases before the courts. Thommessen has developed unique expertise in this area and has litigated numerous cases relating to tax law issues.
Thommessen’s expertise in tax law also covers customs duties and excise duties, where we have represented taxpayers in court in recent years. Our philosophy is to assist taxpayers throughout the entire process when a dispute arises with the tax authorities, from the administrative notice of a change in assessment to the final hearing before the Supreme Court. We represent taxpayers in tax and duty cases, and our experience in handling court cases also makes us better advisers on tax and duty matters.
It is rarely anyone’s intention to end up in a dispute with the tax authorities, but when it happens, we stand by the taxpayer’s side every step of the way.
