Private Enforcement


Private enforcement means that private parties themselves submit claims, typically claims for damages, in the event of violations of rules that are generally enforced by public authorities. It can be competition rules, rules to protect consumers or markets. Such cases are often complex and can give rise to demanding assessments of the basis for liability, causation and assessment of losses.

In recent years, private enforcement has become increasingly important as a supplement to public supervision and regulation, both as individual and as class actions.
